What is OSP License?

OSP License is a form of registration where a company becomes eligible to provide Other Services. OSP full form is ‘Other Service Provider.’ Other Service Providers are providers of IT Enabled services, or application services to be exact. These are companies who engage with services such as BPOs, Call Centres, Tele trading, telemarketing, network operation centres, E-commerce, Tele Banking and other IT Enabled services.

Conditions of OSP Licence

Procedure for OSP License Registration:

  1. Sign up

    Create an account on Saral Sanchar website and Click for DOT OSP license

  2. Fill Form- I & Upload documents

    Fill the form properly with all correct information & also upload all required attachments which must have your digital signature.

  3. Online Application Fee

    Subsequently, pay the required fee through the online payment option of INR 1000 through online banking methods. You can pay this fee offline as well.

  4. Verification

    Then, remove all error if any error appears and then submit the form. Department will check the information and all attached attachments and raise clarification if they needed.

  5. Clarification if any

    Additionally, submit the clarification if raised within a stipulated time limit. You must address any objection or errors raised by DOT authorities.

  6. Issue of License

    Finally, the department will issue the License if all information is true and correct.

Documents required for DOT OSP License Registration

  1. Vendor Certificate for logical partitioning in the EPABX.
  2. Undertaking that the Bank Guarantee of Rs. 50 Lakhs or One Crore as per the case in the prescribed format.
  3. Network diagram – It must clearly mention in the diagram whether it is using Sharing of Infrastructure or Centralized EPABX architecture or the CUG facility.

If interconnection of either one international OSP centre(company A) with another international OSP centre(company B) of Group Company or one domestic OSP centre(company A) with another domestic OSP centre(company B). You require the following documents:

  1. Shareholding pattern of Company A
  2. Shareholding pattern of Company B
  3. Certificate from statutory Auditor of the company to certify that A & B are Group Companies.
  4. Other supporting documents, if any like balance sheet, annual report etc. to establish that company A & company B are Group Companies

Registration Validity

Registration shall valid for 20 years from the date of issue unless otherwise mentioned in the registration letter.

The validity may be extended for a period of 10 years at one time, upon request of the OSP. The OSP must make the request during the 19th year of the registration period on the terms mutually agreed. Finally, the designated authority decisions shall be final in regard to the grant of extension.

How can the OSPs maintain OSP registration compliance?

To maintain the OSP registration compliance, an OSP must submit an “Annual Return” to the DoT within 6 months after completion of a given financial year. The Return should mention the present status and the activities of the OSP. Besides, the OSP should also comply with the terms specified by the DoT, especially for the OSPs.

FAQs

Can I use my OSP license to operate in another location?

No, you can’t. The OSP license is a location-specific one. However, you can apply for another OSP license for operating in another location, with a copy of your RoC incorporation.

Can you obtain more than one registration for a company?

Yes, after receiving registration for one location, the OSP can apply for another location providing the OSP license of the obtained location and a copy of incorporation by ROC.

What if the Annual return is not submitted?

Those OSPs who do not submit the annual return for consecutive three years will be put in the dormant list and their registration will be cancelled. The OSP is on the dormant list for 2 years before such cancellation. The list is available on the DOT website.
