What is IPRS & PPL music License

IPRS – The Indian Performing Right Societies Ltd. and PPL – Phonographic Performance Limited are two leading organizations that provide Music License in India. Music License is a requirement for all the businesses where activities such as pre-recorded music / songs in the form of music Cassette, Gramophone records, Radio, TV, CDs,or in Audio-Visual form, etc are carried out or live songs are performed, as per the Copyright Act, 1957. Playing music in public places for any commercial purposes, it is mandatory for all to obtain such license.

For Playing Pre-recorded Music: Copyright Society for Sound Recording which is Phonographic Performance Limited (PPL) issues music license to entities such as restaurants and cafes who want to play music in their premises.

For performing Live music: In case, any business unit is willing to have singers in their premises for the singing or live concert purpose then business have to approach Indian Performing Rights Society (IPRS) for the license.

IPRS Overview

IPRS – The Indian Performing Right Societies Limited is an organization that permits all music users to use the copyrighted music and collect royalties against that copyrighted music. All IPRS members give this legitimacy to their customers. Thus, the fees received from IPRS customers is distributed among all its members after the reduction of administrative cost of IPRS

The Council of Directors, elected by its members at every General Meeting control the administration and policies of the company. Furthermore, there is an equal representation of authors and composers in every region.

PPL Overview

The Indian Phonographic Industry (IPI) in the year 1941 constituted The Phonographic Performance Ltd. (PPL). IPI is an association of phonogram producers whose main objective is to oversee the broadcasting license agreements in India. The objective of the PPL is to administer the Broadcasting rights and public performances.

Phonographic Performance Ltd. has more than 250 music labels as members. All the member music labels small and large are associated with PPL and it is the responsibility of PPL to protect their Intellectual Property rights.

Any person who is willing to play pre-recorded music in their hotel or any such premises needs to obtain a Music License to avoid any forfeit. Further, the term “any such premises” includes Hotel, Pubs, Restaurant, Events, Cinema Halls, Malls, Sports Events, Aircraft, and Product Launches, etc.
